Coverage

The Firm's principal, Steven G. Fauth, previously served for 15 years as chief legal counsel and head of claims for a leading national property and casualty insurer. As such, he is thoroughly versed in first and third party coverage issues and has litigated those issues successfully for over twenty years. The Firm has litigated first party property coverage actions in the areas of arson and fraud, non-covered perils, a full range of excluded causes of loss in both ISO, URB, MSO and manuscript forms and endorsements. The Firm has numerous reported decisions on significant coverage matters throughout New York State and has counseled clients on coverage issues nationwide. The Firm offers not only litigation capability, including conducting examinations under oath, but also consulting for carriers on issues of coverage, coverage issue handling, and coverage letter preparation. The Firm specializes in assisting carriers with the early investigation and oversight of problematic coverage issues including fraud and arson. The Firm can also assist insurers with developing their forms and coverage interpretations on the first and third party side.

The Firm also specializes in litigating construction site cases and other multi-party type actions, where there are issues of defense and indemnification by other parties, evaluation of tenders from other parties, and additional insurance and "other insurance" issues. These issues most often arise in the context of the defense of those actions, but the Firm's coverage expertise makes it uniquely qualified to guide its clients through these complex and often confusing issues.
